Abstract

Cash flow issues and payment backlogs for many years have been a barrier to development for many traders. Delays in timely payment obligations create payment backlogs that are a serious threat, especially for small and medium-sized companies. For such entities, even a few unpaid invoices can mean the loss of cash flow, which in the long run may even lead to their bankruptcy. The problem currently is even more severe, because the whole economy is in a period of slowdown. Therefore, from the point of view of not only the entities but the whole economy, it is important that operators have adequate instruments by means of which they could defend themselves against dishonest contractors.

The aim of this paper is a critical evaluation of the instruments available to entrepreneurs in the fight against payment backlogs. Polish and EU law was brought to economical analysis which was supposed to be an instrument in a fight against dishonest contractors. However, as is clear from the analysis, the instruments available to economic agents do not provide too much defense against inconclusive payers and dishonest contractors, and impose upon not only the additional responsibilities and restrictions.
